Terms of Service
These Terms govern your use of manddigital.com and the website design service offered on it. The service is provided by MAND INVEST 12003 WA LLC ("Mand Digital," "we," "us," or "our"), a Florida limited liability company. By using this website you agree to these Terms.
1. Who we are
MAND INVEST 12003 WA LLC ("Mand Digital," "we," "us," or "our") operates publicly under the brand name Mand Digital. Mand Digital is a trade name; the contracting party in every engagement is MAND INVEST 12003 WA LLC.
This website is informational. No contract for a project is formed by browsing it. A project begins only through the client portal at app.manddigital.com, under the Project Agreement described in section 3.
2. What the service is
We design and build institutional, lead-generation websites for small and medium service businesses in the United States, primarily contractors and home-service businesses. The standard product is:
- A website of up to 7 pages.
- One language. Additional languages are available at $297 per additional language.
- Copy written for the business, based on the information the client supplies. AI is used in production and a person reviews the work.
- Technical and on-page SEO fundamentals: sitemap, metadata, crawlable markup, semantic structure.
- A lead form that delivers inquiries to an email address the client provides.
- Analytics configuration when the client provides or creates the appropriate account.
- Deployment to hosting the client owns.
E-commerce is not part of the standard product. Logo design, Google Business Profile setup and ongoing SEO services are not included. Work outside the standard product may be handled as a custom project, which starts at approximately $3,500 depending on scope and is quoted separately.
3. The Project Agreement controls the project
Every project engagement is governed by the Project Agreement the client accepts in the client portal at the time of contracting. That agreement sets the project-specific terms, including payment handling, cancellation, refunds and any matter particular to the engagement.
These Terms describe this website and the standard commercial offer presented on it. Where these Terms and the accepted Project Agreement address the same subject, the Project Agreement controls for that project.
4. Price and payment structure
The standard website is $1,497 in total. It is paid in two stages:
- $500 initial payment, which opens the project.
- $997 remaining balance, due after final approval and before the website is published.
There is no mandatory monthly fee payable to Mand Digital and no long-term contract with us. Domain registration and hosting are paid by the client directly to those providers and are not included in the $1,497.
5. Timeline: first preview within 5 business days
We submit a FIRST PREVIEW for the client's review within 5 business days. This is a preview for review. It is not a finished, approved or published website, and nothing in our materials should be read as promising a completed website in 5 business days.
The 5 business days begin only once all of the following are true:
- the $500 initial payment is confirmed;
- the briefing is complete;
- the required materials and information have been received; and
- the briefing and materials have been reviewed and approved for production.
If we are waiting on information, materials, feedback or an approval from the client, the timeline is suspended and extended by the corresponding period. Delays caused by the client do not shorten the window.
6. Revisions
The standard product includes 3 consolidated rounds of revisions. A round is a single consolidated set of change requests, not an unlimited stream of individual messages.
Additional revision rounds are available upon request and may be quoted separately. Requests that change the agreed scope, add pages, add features or amount to a redesign are treated as new work and quoted separately rather than absorbed into an included round.
7. Post-delivery support
The project includes 30 days of post-delivery support, starting when the website is published.
That support covers the website we delivered and the scope that was agreed: corrections, small fixes and questions about how the delivered website works.
It is not a maintenance plan, it is not unlimited changes, and it is not ongoing content management. New pages, new features, redesigns, additional languages and any work outside the agreed scope are not included and may be quoted separately. After the 30 days, further work is quoted separately.
8. Client responsibilities
To deliver the project we depend on the client to:
- provide accurate business information, service descriptions and service area;
- supply any images, logos, licence numbers and other materials the client wants used, and confirm they hold the rights to them;
- review previews and provide consolidated feedback within a reasonable time;
- hold, pay for and maintain the domain and hosting accounts; and
- grant the access needed for us to deploy the website, where the client asks us to handle the technical setup.
The client is responsible for the accuracy and legality of the business information supplied, including licence numbers, certifications, claims about services and any content the client asks us to publish.
9. Domain, hosting and installation
The client owns everything. The domain and the hosting are registered in the client's own name and on the client's own accounts, and the client pays those providers directly. Mand Digital is not a hosting provider and does not resell hosting.
Installation is arranged in one of three ways:
- the client already has hosting and grants us the access needed for us to install and configure the website;
- the client does not have hosting, we recommend a provider (which may be through a referral link), the account is opened in the client's own name, and the client then grants us access; or
- the client prefers to handle installation and configuration themselves.
Where a referral link is used, the account and the relationship with that provider belong to the client. We may receive a referral commission. The client is free to choose any provider.
10. Ownership and intellectual property
On receipt of the full project price, the client receives ownership of the client-specific deliverables produced for the project: the page content written for the business, the client-specific design output and the project files delivered to the client.
That transfer does not include, and we retain all rights in:
- materials Mand Digital owned or created before the project;
- reusable tools, components, libraries, systems and internal processes;
- frameworks and templates used across projects;
- our own brand, name, marks and portfolio materials; and
- third-party, open-source and licensed materials, including fonts, images, plugins and services, which remain governed by their own licences.
Third-party and licensed materials are provided to the client under the terms of their respective licences, not transferred. Until the full project price is received, all rights in the work remain with Mand Digital.
Unless the client tells us otherwise in writing, we may reference the delivered website as an example of our work.
11. No guarantee of results
We include technical and on-page SEO fundamentals. We do not guarantee, and nothing on this website should be read as guaranteeing:
- any search engine ranking, including a first-place or first-page result;
- any level of traffic;
- any number of leads or enquiries;
- any sales or revenue; or
- any specific commercial outcome.
Search engine results depend on factors outside our control, including the actions of search engines themselves, competition, and the client's own market.
12. This website
The content of this website, including prices and product descriptions, is provided for information and may be updated. Prices and terms that apply to a project are those in force and accepted at the time of contracting.
This website links to our client portal at app.manddigital.com. That portal is operated by the same company and has its own terms and privacy notice, which apply to its use.
This website is provided as-is. We do not warrant that it will be uninterrupted or error-free.
13. Limitation of liability
To the maximum extent permitted by applicable law, Mand Digital is not liable for indirect, incidental, special or consequential damages, or for lost profits, lost business or lost data, arising out of the use of this website or the services described on it.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
14. Changes to these Terms
We may update these Terms. The version and effective date at the top of this page identify the current version. Material changes take effect when published here, and do not retroactively change the terms of a project already contracted under an accepted Project Agreement.
15. Governing law
These Terms are governed by the laws of the State of Florida, United States, where MAND INVEST 12003 WA LLC is organised, without regard to its conflict-of-law rules.
